新时期违法所得没收程序之检视与完善——以贪污贿赂案件为背景

摘　　要：党的十八大以来,以习近平同志为核心的党中央把党风廉政建设和反腐败斗争作为全面从严治党的重要内容,以零容忍态度,保持反腐败高压态势,反腐成效显著。党的十九大报告提出"推进反腐败国家立法"。而现实中一些职务犯罪人员逃离境外,难以归案,这对刑事追诉程序的推进造成严重阻碍。2012年,我国在对《刑事诉讼法》进行修改时增设违法所得没收特别程序,开辟处置赃款赃物的新途径,解决追逃追赃的司法困境。新时期我国反腐败形势依然严峻,特别程序实施以来出现一些问题。以此背景对程序予以检视,在寻求其理论价值之源的同时,探究有待完善之处。Anti- corruption and building a clean and honest Party is a strategy to which the CPC Central Committee has attached great importance since the 18th National Congress of the CPC Central Committee. In reality, the embezzlers of job -related crimes flee the country, hide themselves and find it difficult to go to justice, which seriously hinders the advancement of the criminal prosecution procedure. During the revision of the Criminal Pro- cedure Law in 2012, China added special procedures for the confiscation of illegal proceeds and opened up a new way to dispose of stolen money and stolen goods. To solve the dilemma of judicial activities. In the new pe- riod, China＇s anti -corruption situation is still grim, special procedures have been implemented for more than five years, there are some problems. In this context, the procedure is examined, and the source of its theoretical value is sought, and the place to be perfected is explored.
