摘　　要：诉讼保险和法律援助是当事人诉讼费用转移的两种方式。两者都能将当事人的诉讼费用或者其他法律服务费用转移给案外第三人承担,促进底层群众更易接近司法。但是,两种制度的产生、适用范围、适用对象资格、提供服务的形式各有不同。研究两种制度的差异,分析它们的特点,了解和掌握它们的功能,能充分地发挥各自的优势,在不同的人群和领域中,减轻当事人需要法律服务或者进行诉讼的经济负担,更好地维护当事人的合法权利。Litigation insurance and legal aid are two ways to transfer litigation costs. Both can transfer litigation costs or other legal service costs of the parties to a third party outside the case to bear,and promote access to justice for the lower class. However,the two systems are different in their emergence,the scope of application,the qualifications of the applicants,and the forms of servicing. Studying the differences between the two systems,analyzing their characteristics,understanding and mastering their functions can fully exert their respective advantages,lighten the parties＇ need for legal services or the economic burden of litigation in different groups and areas,and better safeguard the legitimate rights of the parties.
