摘 要:中国食品安全法律在民事责任、行政责任和刑事责任相关制度上存在不完善之处,对受害方救济不足,对责任主体惩治不力,导致食品安全事件频发。通过对现行法律制度具体分析,提出完善食品安全法律责任制度的建议,如加大救济和惩罚力度等,从而全面杜绝食品安全问题。There are many imperfections in laws of food safety in China in terms of civil liability, admin-istrative liability and criminal liability. Food safety incidents frequently occur due to the insufficient relief to the injured party and the inadequate punishment to the responsible party. Based on the analysis on the cur-rent legal system,the paper suggests strengthening both relief and punishment to perfect the legal liability system and put an end to food safety problems.
