摘　　要：随着全球经济一体化的发展,尤其在我国"一带一路"倡议下,更多的企业走出去参与境外投资,势必带来大量的商事争议与纠纷。为了追求商业效率,当发生商事争议与纠纷时,企业更愿意选择仲裁这种方式解决。我国相关法律虽然没有明确禁止反垄断争议的可仲裁性,但由于反垄断争议存在一定的特殊性,在实践中,当事人将反垄断争议提交仲裁机构申请仲裁的情形并不常见。与我国其他解决民商事纠纷方式相比较,仲裁具有自愿性、专业性、灵活性、保密性、独立性及便捷性等优势。因此,在不违背我国相关法律法规及社会公共利益的情况下,我们应当鼓励当事人将部分反垄断争议提交至仲裁机构仲裁,通过完善我国的仲裁法及反垄断法的相关法律制度,将反垄断争议的可仲裁性在立法上予以明确,在实践中行之有效。With the development of global economic integration, especially under the ＂One Belt, One Road＂ strategy of Chi- na, more enterprises go out to participate in overseas investment, which will inevitably lead to a large number of commercial disputes .In order to pursue commercial efficiency, companies are more willing to choose arbitration to solve their problems when disputes occur.Although there are no relevant laws to explicitly prohibit the arbitrability of anti-monopoly disputes in China, it is not uncommon for parties to submit anti-monopoly disputes to arbitration institutions for arbitration／ due to the specificity of anti-monopoly disputes.Compared with other ways of resolving civil and commercial disputes in China, arbitra- tion has the advantages of voluntary, professional, flexible, confidential, independent and convenient.Therefore, without vio- lating China＇s relevant laws and regulations and social public interests, we should encourage parties to submit some anti-mo- nopoly disputes to arbitration institutions for arbitration.By perfecting China＇s arbitration law and the relevant legal system of anti-monopoly law, the arbitrability of anti-monopoly disputes will be clarified in legislation and will be effective in practice.
