甘肃省293例肇事肇祸案件司法精神医学鉴定分析

摘　　要：目的了解甘肃省司法精神医学鉴定现状与特点,探讨精神病患者的涉案特征,为精神病患者肇事肇祸的预防和评估提供参考。方法对兰州市第三人民医院2013年3月-2016年2月的293份司法精神医学鉴定资料的人口统计学及犯罪学特征进行分析。结果 293份鉴定资料中,男性201例(68. 6%),女性92例(31. 4%),男女涉案比例为2. 18∶1;男性和女性的平均年龄分别为(36. 47±11. 63)岁和(35. 21±11. 38)岁;初中及以下受教育程度者209例(71. 3%);有精神障碍者283例(96. 6%),无精神障碍者10例(3. 4%);凶杀案113例,占刑事案件的47. 3%;完全责任能力者24例(8. 2%),限定责任能力者100例(34. 1%),无责任能力者169例(57. 7%)。结论甘肃省肇事肇祸精神病患者以中青年男性为主,多无业且受教育程度较低,刑事案件比例较高,以凶杀、伤害案件为主,作案时多伴幻觉、妄想等精神症状,多无责任能力。Objective To understand the current situation and characteristics of judicial psychiatric identification in Gansu Province,and to explore the features of patients with mental illness in the chosen cases,so as to provide references for prevention and evaluation on troubles and accidents among patients with psychiatric diseases. Methods Demographic and criminological characteristics of forensic psychiatry expertise in 293 cases from the Third People ＇s Hospital of Lanzhou from 2013 March to 2016 February were analyzed. Results Among the data of 293 cases,there were 201 males（68. 6%） and 92 females（31. 4%）,and the male-female ratio was 2. 18∶1. The average age of male and female was（36. 47 ± 11. 63） years old and（35. 21 ± 11. 38） years old respectively.209 persons（71. 3%） from the chosen cases had a primary or middle school education only,283 cases（96. 59%） were diagnosed with mental illness while 10 cases（3. 41%） were not. 113 cases were homicide,which share 47. 3% of criminal cases. 20 persons（6. 82%） had capacity of full liability,94 cases（32. 08%） had capacity of limited liability and 179 cases（61. 10%） had no capacity of liability. Conclusion Among troubles and accidents cases caused by people with mental illness in Gansu,most of them are young and middle-aged male,and vast majority of persons in 293 cases are unemployed and lower-educated. The proportion of criminal cases is relatively high and majority of those cases are murder and hurt. Many persons experienced hallucinations and delusions when they are committing a crime,and most of them have no capacity of liability.
