摘　　要：一见义勇为认定中存在的问题与难点 见义勇为是古今中外广泛认同的美德,对维护生命价值、构建和谐社会具有积极促进作用。可是,见义勇为在认定上面临严重的困境。这种认定困境既表现在见义勇为的概念在理论阐释上存在难点,又表现在见义勇为的行为在现实生活中存在问题。Good Samaritan action is the virtue approved in all times,and it has positively maintained the life value and promoted the harmonious social construction.However,it is not easy to identify the nature of Good Samaritan action.The report holds that it must sticks to two principles while identifying Good Samaritan action.The first principle is justice.The Good Samaritan action itself must belong to justice which embodies the public spirit.The second is the voluntary principle.The Good Samaritan action itself must be voluntary,that is to say,it must embody the free will of the agent and his/her own choice.Good Samaritan action requires both justice and voluntary principles.Neither the voluntary action without justice nor the justice action without voluntary spirit can be regarded as Good Samaritan action.It is only the justice action with voluntary spirit which can be regarded as Good Samaritan action.
