摘  要:《物权法》对用益物权的定义性规定中将动产作为用益物权客体并不违反物权法定原则,动产用益物权在当代社会仍有其制度价值。《民法典》"物权编"应对典权、居住权作出规定;应将集体建设用地纳入建设用地使用权客体范围,实现"同地同权";"土地经营权"不宜作为一种用益物权予以规定。物权法应赋予土地承包经营权、宅基地使用权人更大的处分自由以彰显其财产权本质,并对其物权变动统一采取"登记生效主义。"In the definition of usufructuary right of property right law in the "Property Law", the use of movable prop- erty as the object of usufructuary rights does not violate the legal principle of property rights. The property right of movable property still has its institutional value in contemporary society. The "Civil Property Code" shall stipulate the code authority and the right of residence; the collective construction land shall be included in the scope of the object of construction land use fights, and "the same fights and fights at the same place" shall be realized; "Land Management Right" shall not be used as a kind of utility item. Rights are provided. The property fights law should give people greater freedom in land con- tracting management and homestead use fights to highlight the nature of their property fights, and adopt a "registration ef- feetiveism" for their property rights changes.
