教育行政执法存在问题及法律风险防范的实证分析*--以2014-2015年南方某省教育行政案件为例

摘　　要：教育领域依法行政、依法治教是新形势下对教育行政部门提出的必然要求。一个地方教育行政案件的基本状况一定程度上是该地教育执法工作水平的晴雨表。通过对南方某省2014-2015年的教育行政案件的实证分析,发现近两年该省教育行政部门行政案件急剧增加,反映了教育行政部门的有关人员在执法工作中存在依法行政意识不强、重实体轻程序等问题。为减少教育行政执法工作的诉讼等法律风险,本文提出了一些建议措施。Under the new situation,administration according to law and governing the education by law of the field of education are the inevitable requirement of the education administrative department.The basic situation of a local educational administrative case, to a certain extent, becomes a barometer of the level of educational law enforcement. To analysis the empirical education administrative cases to this province of 2014-2015 year, found that the cases of the provincial administrative department of education has increased dramatically in the recent years, which reflecting the relevant staff of education administrative departments involved in the work of law enforcement problems,such as lacking of the consciousness of administration by law, attaching less important in procedure compare to affair. In order to reduce litigation and other legal risk of law enforcement in educational administration as example, some suggestions are putting forward in this paper.
