摘　　要：党的十八届五中全会提出"互联网+"战略。"互联网+"时代的来临,更加敦促我们高度关注网络交易平台提供者在现行法律体系下应有的位置和归属。网络交易平台提供者作为注意义务的特殊主体,对其平台使用者承担善良管理人的注意义务。因而运用法律手段对网络交易平台提供者的注意义务进行规制十分必要。在互联网立法背景下,用良法实现网络交易的善治,同时借助法律手段不断完善适应现代社会发展以及各方主体利益平衡需要的规则,是现代民商法、经济法发展的趋势。The Fifth Plenary Session of the18th CPC Central Committee proposed the"Internet plus"strategy."Internet plus"era more urged us to pay high attention to the online trading platform provider忆s location and its ownership position under thecurrent legal system.And the online trading platform providers,as a special subject of the duty of care,should take goodmangers忆duty of care for its users.Therefore,it is necessary to use legal means to regulate the online trading platformproviders忆duty of care.Under the background of the Internet legislation,it is the trend of modern civil and commercial lawand economic law to use the just law for the realization of the good governance of online transaction,at the same time withlegal means,constantly improving adaption to the development of modern society and the rules needed by the balancedinterests of all parties with legal means.
