摘　　要：尽管我国主审法官制度已经进入协调发展阶段,但其权力责任的正面清单和负面清单尚不明确,难以通过限制和调整功能实现权责利的统一。以司法体制改革的总目标观之,主审法官不仅应是个别正义的具体提供者,而且在合议庭架构中是集体行使审判权的组织者,在团队化运作模式中更是居于核心地位的管理者,是具有绝大部分审理裁判权能、对团队成员享有审判管理权限,并对承办案件终身负责的员额内法官。鉴于权力责任具有社会关系属性,清单设置必然依附相对主体的特征,只有在正确厘定主审法官与相关主体的功能定位和逻辑关系基础上,从微观的个案裁判、中观的审判组合管理、后续的责任承担和利益保障等角度逐项框定主审法官的权力责任清单,才是真正落实审判权独立公正高效运行的必然要求和现实选择。Although the presiding judge system has already stepped on the stage of the coordinateddevelopment in China,the positive and negative lists of rights and responsibilities of the presiding judge havenot been clarified.It is difficult to realize the reunification of rights and responsibilities by the restriction andadjustment functions.According to the general goal of the judicial system reform,the presiding judge should notonly be the specific provider of individual justice,but also be an organizer of collective jurisdiction exercise ina collegial panel structure and be the core administrator in the team operation mode as well.He is supposed tobe a judge,ever responsible for the cases handled,within the specified number of personnel with most trial andjurisdiction right and the authority of trial management towards team members.In view of the social relationnature of rights and responsibilities,the setting of list must rely on the characteristics of relative subjects.Onlybased on accurately defining the functions and logical relationship between the presiding judge and relevantsubjects,setting the list of the rights and responsibilities of the trial judge one by one from the perspectivesof microscopic case trial,the meso-scopic group management of trials as well as the following responsibilityundertaking and interests guarantee is the inevitable requirement and realistic choice for the real implementationof the independent and efficient operation of the judicial power.
