摘  要:自《劳动合同法》实施十年以来,中国劳动关系步入了新的法制化阶段。回顾近十年来(2008—2017年)学者的研究表明,《劳动合同法》对维护职工权益、构建和谐劳动关系有积极影响。但是在某些具体条款实施中,如劳务派遣"三性"界定尚不明确,还有需要完善之处。不同学者对《劳动合同法》的修法立场分为三类,即支持、反对、中立。当前中国劳动关系正处于转型期,总体稳定,具有市场经济国家共同特点。After ten-year implementation of the Labor Contract Law,China’s labor relations have stepped into a new legalization stage.Ten years’(2008-2017)researches by scholars proved that the Labor Contract Law has positive impact on safeguarding worker’s interests and rights and building harmonious labor relations.However,when it comes to the implementation of some specific terms,there is still some disadvantage to be improved.For example,three features of labor dispatchment are still not clear.Different scholars have different attitudes towards changing the Labor Contract Law.They’re briefly divided into three kinds:being supportive,opposed and neutral.At present,the labor relations in China are in transitive phase,maintain stable and have characteristics of market economy countries.
