现场勘验、检查中见证人制度分析

摘　　要：在现场勘验、检查这个环节中,见证人制度是一项非常重要的保障性措施。该程序在很大程度上可以预防侦查机关取证过程中的随意性,以确保现场勘验、检查的公平、正义、合法。但目前该项制度在具体实践中存在一些问题与不足,主要表现在立法规定和司法实践等方面。文章通过探讨分析这些问题,提出改进和完善的对策建议,并制出《现场勘验、检查见证人权利义务告知书》的标准样式,希望能为完善见证人制度提供启示与借鉴。During the process of on-site investigation and inspection,the witness system is a very important safeguard measure to ensure fairness legitimacy and justice in the field of observance to a large extent.However,there are some problems and shortcomings in the practice of the system.These problems are mainly reflected in the legislative provisions and judicial practice and so on.The article puts forward some suggestions on how to improve and perfect the system by discussing these problems,and producing The Notice of On-site Investigation,Inspection of Witness Rights and Obligations,hoping to provide enlightenment and reference for perfecting the witness system.
