摘  要:"礼"既是儒学的核心范畴,亦是中国古代社会治国理政的重要方略。儒士们对"礼"进行了持续不懈的论究:从具体事物的礼仪规范,到普遍的社会规则;从礼的内涵本质,到礼的价值功用;从制礼的准则依据,到礼与法(刑)之间的关系等。《礼》有"三礼",其中的《礼记·曲礼》提出了"礼不下庶人,刑不上大夫"的著名论题,由此也引发了历代学者的争议和探幽。对这一论题进行当代诠释,既有助于深化对古代社会礼治思想和制度的理解,也有助于当今中国在"新时代"实行以德治国与依法治国相结合方略的贯彻落实。The"rite"is not only the core category of Confucianism,but also an important strategy of governing the country in Chinese ancient society.The Confucian scholars consistently devote themselves to the study of"rite"from various perspective,including the etiquette standard of specific things,the general social rules,the connotation of rites,the value function of rites,the criterion of setting up ritual,and the relationship between rite and law(punishment).Liji?quli(the book of rites)proposed“Li-bu-xia-shu-ren,Xing-bu-shang-dai-fu”(rites do not apply to the common people and punishments do not apply to the nobles),which caused controversy among scholars.A contemporary interpretation of this proposition is helpful to understand the rule of rite in ancient society,and also helps to put the strategy of combining the rule of virtue with the rule of law into practice in the"new era"of China.
