摘  要:审视农民住房抵押贷款既有制度安排,发现试点实践中存在金融机构无法适用传统抵押权实现方式、房屋受让对象范围限定过窄和抵押权实现后"房地分离"等问题。遵循物权平等保护原则,在农民住房抵押权实现时引入"强制管理制度",根据地域特征有限度地扩大农房抵押处置时受让人的范围,推定集体经济组织以外的新房屋所有权人对宅基地享有租赁权,赋予集体经济组织及其成员优先购买权。Examining the existing institutional arrangements for peasant rural housing mortgage loan,it is found that there are problems in the pilot practice,such as the inability of financial institutions to apply traditional mortgage rights,the narrow scope of housing assignments,and the separation of premises after mortgage rights realized.Following the principle of equal protection of property rights,the“compulsory management system”is introduced when the peasants’mortgage rights are realized.When the rural house is mortgaged,the assignee’s scope is limited to expand according to the geographical characteristics,and it is presumed that the owners of new houses other than the collective economic organizations have leasehold,giving the collective economic organization and its members the right of preemption.
