巢湖流域环境司法专门化的缘由与路径——以环境司法专门化趋势为视角

摘　　要：作为对环境纠纷复杂性的回应,环境司法正朝着着专门化趋势发展。实施流域内环境司法专门化,符合流域环境资源整体性规律,有利于司法统一;有利于流域环境行政执法的有效落实;有利于保障流域环境主体的环境权益。巢湖流域可以在合肥市中级人民法院建立环境保护法庭,跨区域集中管辖涉及巢湖流域的环境资源案件,创新流域内环境司法机制,科学配置司法队伍,优质高效审理环境案件,为流域生态文明建设提供有力的司法保障和服务。As a response to the complexity of environmental disputes,environmental justice is developing toward a specialized trend.The implementation of the judicial specialization within the basin conforms to the law of the integrity of the basin′s environmental resources and is conducive to judicial unity.It is also conducive to the effective implementation of environmental administrative law enforcement and the protection of environmental rights of the basin environment.The Chaohu basin may set up an environmental protection court in the Intermediate People′s Court of Hefei,which would have centralized jurisdiction over cross-regional environmental and resources cases in the Chaohu Basin,create environmental justice mechanism in the basin,allocate scientifically the judicial personnel,try with high quality and efficiency the environmental cases and provide a powerful judicial guarantee and service for the ecological civilization construction of the Chaohu basin.
