摘 要:近年来国内外无人驾驶汽车技术发展突飞猛进,前景十分广阔,但其商业化发展却面临诸多法律困境,例如无人驾驶汽车本身与现有驾驶制度和驾照制度之间的冲突,智能系统加剧隐私泄露风险以及预设程序成为道德难题等,其中,首先需要解决的是我国无人驾驶汽车道路交通事故的责任划分和风险负担问题。目前美、德、英等国纷纷着手构建无人驾驶汽车相关法律制度,而我国在该领域的立法尚属空白。无人驾驶汽车技术的日益完善和国家产业政策的建设目标需要同现行法律制度之间的冲突,实质上阻碍了我国无人驾驶汽车技术的商业化发展。借鉴国外规定,并结合我国实际,尝试从划分主体责任、修改相关法律法规以及建立特殊保险制度等方面对无人驾驶汽车道路交通事故相关法律问题进行探讨。Recently,the technology of autonomous vehicle has developed rapidly at home and abroad and it’s a promising industry.But its commercial development faces plenty of legal difficulties,for example,the conflict between the autonomous vehicle itself and the existing driving system and driving license system,serious privacy disclosure and the ethical dilemma of preset program,etc.The problem to be first settled among numerous and complicated legal problems is the division of legal responsibility and risk bearing in a road traffic accident of driverless car.The United States,Germany,Britain and other countries currently have embarked on the construction of the legal system on driverless cars,while the legislation in our country is still blank.The conflict between technological improvement and national industrial policy goals and the current legislation system has substantially restricted its commercial development in our country.Drawing lessons from foreign experience,combining with national situations,this paper tries to solve the issue through dividing subject liabilities,amending relevant laws and establishing special insurance system.
