摘 要:《不动产登记暂行条例实施细则》规定,因被担保债权主债权的债务履行期限发生变更申请抵押权变更登记时,如果该抵押权的变更将对其他抵押权人产生不利影响的,还应该提交其他抵押权人书面同意的材料。由于其他债权人的同意难以取得,这种做法导致先顺位抵押权的银行在办理续贷时陷入两难境地。文章以传统民法理论为依据,通过比较法研究,梳理了当前我国关于抵押权的相关规定,认为即使抵押权人超过被担保主债权诉讼时效行使抵押权,也不会发生抵押权消灭的法律后果,被担保主债权履行期限变更并不影响其他抵押权人的利益,不动产登记机构办理变更登记时不应要求提交其他抵押权人书面同意。Due to The Interim Regulations on Real Estate Registration Rules,when the debt performance period of the secured creditor's right has changed,applying for registration of mortgage change,the written consents of other mortgagees should be submitted,if it has adverse effects on other mortgagees.For the difficulties of the consents of other creditors,the bank with the mortgage right first also has difficulties on renew loans.On the basis of traditional theory of civil law,this paper sorted out the relevant regulations on mortgage right in China,with the study of comparative method,considering that the mortgagee claimed his exceed limitation mortgage right,the legal consequences of foreclosure would not occur,and the other mortgagees’interests would not be affected by the changing of the mortgage master contract,also the written consents of other mortgagees should not be required when handling the changing registration.
