高校学生意外伤害事故处理的困境与改进策略——基于云南某高校十年学生意外伤害事故处理的实践

摘　　要：随着高校学生人数的逐年攀升,学生意外伤害事故的频发成为社会普遍关注的热点问题。基于云南某高校十年学生意外伤害事故处理的实践,通过分析高校意外事故产生的原因,可以把事故分成校方责任型,自身责任型,第三方责任型和无法回避型。总结出事故处理的难点是与家属协商难度大,不易掌握法律法规的尺度,高校面临的赔偿压力增大和赔偿尺度难掌握。提出国家层面应尽快制定完善法律法规;在高校建立保险机制;加强对学生多方面的安全教育;完善突发事件预防机制等措施。With the increasing number of students in colleges and universities,the frequent occurrence of accidental injuries among students has become a hot issue in the society.The article first analyzes the causes of accidents in colleges and universities,and divides the accidents into school-responsible,self-responsible,third-party liability and unavoidable types.According to the results of the accident handling,some difficulties are summarized that it is difficult to negotiate with family members;it is difficult to grasp the scale of laws and regulations;it is difficult to master the compensation scale;and the pressure of compensation faced by colleges and universities is increased.Finally,the countermeasures for preventing and dealing with accidental injuries among college students are proposed:the state should formulate perfect laws and regulations as soon as possible;colleges and universities should establish insurance mechanisms,strengthen safety education for students in various aspects and improve emergency prevention mechanisms
