用法治方式化解社会主要矛盾

摘　　要：社会主要矛盾的变化导致化解矛盾的方式发生改变。由于新时代人民对美好生活追求的多样性,决定了不能仅用经济发展的方式来化解主要的社会矛盾,而是要运用多种方法来满足人民对美好生活的需求。其中,法治方式是极其重要的方法。如何运用法治方式化解社会主要矛盾是国家和社会治理现代化的重要命题,需要我们认真研究。社会矛盾是一个集合概念,化解社会矛盾是政治社会学的概念。从规范法学的角度看,要想用法治方式化解社会矛盾就需要把社会矛盾"转化"为具体矛盾。对具体矛盾的解决可以用不变的法律应对变化的社会矛盾,即持法达变。以简约的法律应对复杂的社会矛盾,在开放的法律体系中运用体系解释、法律论证等方法解决具体矛盾。The change of the social principle contradiction entails that of the way to resolve it.In the New Era,the diversity of happiness lives of the people determines economic development is not only the way to resolve the social principle contradiction,but the various supplements to satisfy people's aspiration of happiness lives.Among them the method of the rule of law is the pretty significant.How to resolve social principle contradiction with the method of the rule of law,which is an important proposition of the administrative modernization about the country and society,needs researching carefully.Social contradiction is a collective concept and resolving it is a political-social concept.From the perspective of the Normative Jurisprudence,resolving social contradiction with the method of the rule of law must transform it into specific contradiction.It would be defused smoothly by using stable law to answer changing social contradiction,namely adjust certain legal norms legally,deal with complex social contradiction with a simple law and using systematical interpretation,legal argumentation and other methods to solve the specific contradiction in an open legal system.
