改革开放以来我国体育法治特色化发展探略

摘　　要：改革开放以来,在依法治国愈益全面的推进中,我国体育法治在随动国家法治发展进程和承载国家法治建设使命的同时,呈现出由体育领域内在需要所形成的鲜明个性,有必要以特色化视角对我国体育法治发展进行考量。通过梳理概括,从发展步骤的某些特定节点、制度保障以大量规范文件为支撑、体育部门与相关部门协同联动、体育全球化和组织国际化的影响、体育社会组织的较大治理空间、某些法律适用和纠纷解决存在差异等方面,阐释了我国体育法治特色化发展的主要表现。进而在理性评价我国体育法治建设现状特点和明确坚持中国特色社会主义法治发展根本方向的同时,从我国体育改革发展和法治建设的客观基础和现实需求出发,提出了新时代继续推进我国体育法治特色化发展的有关期待与建议。As the progress of governing countiy by law since the economic reform and open up,China^s sports rule of law,except for bearing the missions of promoting and constructing governing country by law,gradually presents distinct characteristics formed by the inner needs of sports field.Under this circumstance,it is necessary to consider the development of China's sports rule of law from characteristic perspective.Based on collation and generalization,the major manifestations of characteristic development of China's sports rule of law was illustrated from the aspects of specific nodes of development steps,support of system guarantee and normative documents,the coordination between sports sector and relevant departments,influence of sports globalization and organizational intema-tionalization,greater governance space of sports social organizations,and difference between law application and dispute resolution.Furthermore,apart from rationally evaluating the status of China's sports rule of law and clarifying to insist on the fundamental direction of socialist rule of law with Chinese characteristics,the expectations and suggestions for constantly promoting the characteristic development of China's sports rule of law in new era were proposed by starting from the objective basis as well as realistic needs of China^s sports reform and rule of law.
