摘　　要：1918—1926年间,中国知识人在传播马克思主义时,从方法论和具体学说两方面丰富发展了马克思主义法律观,初步形成中国马克思主义法律观,中国的马克思主义法学也由此发轫。早期中国马克思主义法律观在传播过程中与当时其他法律观念相互激荡,在对法律本体问题、法律与权利及自由、法律与国家政权及民主政治等主要方面、多个问题的认识上,具有以中国政治文化整合西方法律观念进而建构工具主义法律观和革命法政话语的鲜明时代特征。由于改造国家政治和社会经济的实际需要,早期中国马克思主义者们接受了马克思主义的历史观、经济说和阶级论,旨在证明无产阶级专政的政治正当性。这顺应了当时国民革命和社会改造的趋势,却也强化了法为治具的观念。返本以开新,早期中国马克思主义法律观沉淀的以人为本位的权利观和民主为导向的权力观等有益的法律文化元素,值得当今继续启蒙和实践。When spreading Marxism in China from 1918 to 1926,Chinese intellectuals enriched and developed the Marxist legal view from two aspects:methodology and concrete theory.As a result,China’s Marxist view on law began to take shape,hence the beginning of China’s Marxist jurisprudence.In the early period,the legal concept of Marxism in China was in strong interaction with other legal concepts.On such major issues as the legal ontology;law and rights;freedom;law and state power;and democratic politics,China’s early Marxist legal view was characterized by the then Chinese political culture which was intended to incorporate the western legal views in order to construct an instrumental view on law and create a legal and political discourse for revolution.Due to the pressing need for transforming the national politics,society and economy,the early Chinese Marxists accepted Marx’s views on history,economy and social class,which were adopted to prove the legitimacy of the dictatorship of the proletariat.This followed the trend in national revolution and social reform in that period,but at the same time strengthened the idea of regarding law as a tool for governance.Tracing the origin can bring about new understandings:among others,the legal culture elements like the people-oriented view on rights and democracy-oriented view on power embedded in China’s early Marxist legal views are worthy of sustained notice in bot h theory and practice today.
