摘　　要：器官移植存在法律风险;而非法器官移植甚至可能构成犯罪,医疗机构则在非法器官交易中扮演至关重要的角色。文章从我国人体器官移植中医疗机构参与的方式和国内外相关法律规定入手,分析了在非法器官移植中我国医疗机构所需要承担的法律责任,进而从行政责任、民事责任、刑事责任等方面提出了对策建议,以期有助于器官移植法律责任制度的完善。Organ transplantation is a major breakthrough in medicine,and many patients who are dying have gained rebirth through this medical achievement.But organ transplantation carries legal risks,and illegal one can even constitute a crime,in which medical institutions play a crucial role.This paper analyzes the legal responsibili-ties of Chinese medical institutions in illegal organ transplantation from the perspectives of the ways of medical insti-tutions'participation in human organ transplantation and relevant laws and regulations at home and abroad,and puts forward countermeasures and suggestions from the aspects of administrative liability,civil liability and criminal lia-bility in order to help perfect the legal liability system of organ transplantation.
