摘  要:《国家中长期教育改革和发展规划纲要(2010~2020年)》明确提出“高校应依法治校,依法制定大学章程”,这是大学走向依法治校的关键一步,也是实现现代大学制度创新的重点。而大学章程建制如何体现现代大学制度创新之精神,则是大学普遍关注但又极难破解的难题。大学章程如何反映内部治理结构、如何体现多元利益主体诉求、如何处理建制中的若干矛盾关系以及大学章程建制的理论基础与政策规范等问题,已成为当前中国大学章程建制过程中需要解决的重点。本研究基于对国家政策、治理理论以及实践基础的认识,主要从大学功能定位、程序规范以及建制原则等方面入手,对在现代大学制度建设框架下的大学章程建制的若干问题进行了初步思考,希望对我国当前大学章程的建制工作起到一定的促进与引导作用。“The National Medium-to-Long-Term Educational Reform and Development Plan(2010-2020)”has explicitly stated that“universities should govern by the law,and accordingly establish their statute systems”.It is not only a key step toward higher education s goal of governance by the law,but also the focal point of intuitional innovation of modern higher education.However,although the question of how the establishment of the statute system should reflect the spirit of modern higher education intuitional innovation has been widely discussed,yet few answers were offered.How should the university statutes reflect the internal governance structure,represent the interests of multiple groups,handle a variety of conflicts arose during institutionalization,along with the questions related to the theoretical foundation and policy framework for the establishment of university statute systems,have become the hot issues facing China s universities in their current effort toward establishing their statute systems.Taking the perspectives of university s functional identity,procedural specification and institutional principle,this article discussed a few issues regarding university statute establishment under the modern university institutionalization framework based on notions in national policy,governance theory and governance practices.
