死刑制度废除的理性解构——以杀人偿命观为视角

摘　　要：死刑制度的存废受到常识主义刑法观的影响,最直接的表现为:杀人偿命,天经地义。从杀人偿命观与死刑制度存废的关系演变中可以看出,死刑制度的废除需要制度变革与观念变革同行,观念变革可以促进制度变革。在观念变革当中,以传统的杀人偿命观为视角,重新解构传统的法律文化,为死刑制度的废除提供了一种新的路径方式。The death penalty system is influenced by the common sense view of criminal law.From the evolvement of the relationship between the concept of killing for life and the death penalty system,we can see that the abolition of the death penalty system requires the reform of the system and the change of the concept,and the change of the idea can promote the reform of the system.In the process of concept change,the traditional view of killing for life is taken as the angle of view,and the traditional legal culture is deconstructed again,which provides a new way for the abolition of the death penalty system.
