发达国家残疾人体育法制建设经验对我国的启示

摘　　要：对发达国家残疾人体育法制建设情况进行分析,研究发现:发达国家重视残疾人体育法制建设并各具特色;残疾人体育法制建设有着广泛的社会组织参与和民众支持;能适时为残疾人参与体育活动提供法律帮助;判例法对维护残疾人体育权益发挥导向作用。得出启示:强化与完善残疾人体育法制建设;厘清与明确残疾人体育法规的部门职责;引导与鼓励社会力量和公民维护残疾人合法体育权益;加大残疾人公共体育设施的立法力度;借鉴与实施保障残疾人体育权益的法规范式。The construction and improvement of legal system for disabled sports plays an important role in the development of sports for the disabled and the harmonious development of the society.Developed countries attach importance to the construction of legal system of disabled sports,and show their own characteristics.The construction of sports legal system for people with disabilities has a wide range of social organizations to participate in,and to obtain public support with timely legal assistance for persons with disabilities to participate in sports activities.The case law plays a guiding role for the maintenance of the rights and interests of the disabled sports.It is important to strengthen and perfect the construction of disabled sports legal system,to clarify responsibilities of the relative departments,to guide and encourage social forces and citizens to safeguard the legitimate sports rights and interests of the disabled,to intensify legislation on public sports facilities for disabled people,to implement the legal paradigm for protecting the rights and interests of disabled people.
