摘 要:近年来,人工智能与行业应用深度融合。以医疗领域为例,人工智能技术被广泛应用于虚拟医疗助理、病历分析、辅助诊断、药物研发、基因测序等应用场景,由此产生了大量"人工智能+医疗"的创新解决方案。由于人工智能的核心是算法和模型,因而,就这些创新成果的专利保护而言,其本质上仍然离不开涉及计算机程序的发明这一话题。本文从人工智能技术应用于医疗领域的行业现状入手,分析了该领域的技术创新特点,梳理了该领域的国内外专利保护现状,进一步讨论了我国现行专利保护制度下,"人工智能+医疗"创新方案在专利授权、确权和维权阶段所面临的难题和挑战。In recent years,artificial intelligence(AI)has been deeply integrated with industrial applications.Taking the medical field as an example,AI technology has been widely used in virtual medical assistant,medical record analysis,auxiliary diagnosis,drug research and development,gene sequencing and other application scenarios,resulting in many"AI+medical"innovative solutions.Since the core of AI is algorithms and models,patent protection of these innovative achievements is essentially inseparable from computer programs invention.The paper sets out from the current situation of the AI technology applied in the field of medical industry,analyses the characteristics of technological innovation in the field,and summarizes the domestic and foreign patent protection in this field.Then,the further discusses the challenges and problems about obtaining,validating and protecting the patent rights under the current patent system in China.
