宅基地“三权分置”的法理解析与立法回应

摘　　要：解读宅基地"三权分置",真正落实宅基地集体所有权,需要对集体经济组织按照特别法人的主体地位进行改造。宅基地农户资格权应包括宅基地分配资格权和宅基地使用权两种权利,是一种兼具身份权和财产权的复合性权利;农户行使并实际取得宅基地使用权后,宅基地资格权就等同于既有实定法中的宅基地使用权。社会主体享有的宅基地使用权应分为债权性宅基地使用权和物权性宅基地使用权。在宅基地"三权分置"的推进中,应解决宅基地"三权分置"政策术语与法律术语的衔接,未来修法应体现宅基地"三权分置"的成果。The rural homestead system of“two rights of a piece of rural homestead”in force is not adapted to the needs of China’s current rural economic development.And the“separation of three rights relating to rural homestead”came into being.By interpreting“separation of three rights relating to rural homestead”based on policy documents,it is necessary to reform the rural collective economic organizations according to the legal subject status of the special legal person,in order to truly implement the right of collective ownership of the homestead.The rights of farmers’qualification of homestead should include two kinds of rights:the qualification right of the homestead to be distributed and the right to use the homestead.It is a compound right that combines the natures of the identity right and property right.After the farmer exercises and actually obtains the right to use the homestead,the qualification right of homestead is equivalent to the right to use homestead in positive law.The right to use the rural homestead enjoyed by the social subject should be divided into the right to use homestead of the obligatory right and the right to use homestead of the property right.During the promotion of separation of three rights relating to rural homestead,we should solve the problem of the connection between the policy terminology and legal terminology concerning the separation of three rights relating to rural homestead.The process of amending the law in the future should reflect the achievement of the separation of three rights relating to rural homestead.
