摘　　要：2015年国务院颁布《关于机关事业单位工作人员养老保险制度改革的决定》,开启了中国机关事业单位工作人员养老保险制度性嬗变的历程。这一法治举措至少在两个层面展示了其制度逻辑:一是实现公民权利的平等塑造,构建立足宪法平等权的公民养老保险法律保障;二是将养老保险回归至"以人为本",保障人权的制度定位,彰显了国家治理理念从注重经济发展、追求效率正义向更加注重人的全面发展、追求公平正义的转型。按照这一制度逻辑,并轨的养老保险制度应当坚持发展型社会保险理念,树立合理的公平观和效率观,进一步强化政府的责任。In 2015,the State Council issued the decision on the reform of pension insurance of government departments and public institutions staff,which initiated an institutional evolution of pension insurance of staff in government departments and public institutions in China.This statutory action has displayed its own systematic logic at least in the following two aspects:one is to establish a series of legislation protection of civil pension insurance based on constitutional right of equality so that civil rights would be equally exercised.Another one is to bring pension insurance back to where it ought to be,namely putting people first and safeguarding human rights.And such idea could fully highlight the transformation of national governance concept from paying attention only to economy development and efficiency justice to caring about integrated development of citizens and pursuit of fairness and justice.Also in accordance with this philosophy,the merging of pension insurance should adhere to the concept of developmental society insurance,set up a reasonable view of justice and efficiency,and reinforce government responsibilities furthermore.
