以“审判中心论”鼎革与续造中国民事审判

摘　　要：十八届四中全会《决定》提出了"审判中心论"。"审判中心论"重塑了对民事审判的新体认,即民事审判是民事解纷各机制的中心,民事裁判是民事审判的中心,民事请求权裁判是民事裁判的中心。应当以"审判中心论"建设法院中心型民事解纷全机制,即推动与完善平行解纷机制建设,拱卫民事审判作为民事解纷各机制的中心;推动与完善平行法院建设,方便当事人接受与接近作为民事解纷中心的民事审判。同时还应当以民事裁判公信力筑牢民事审判中心,包括以请求权裁判锻造民事裁判的司法公信力,培养具备树立司法公信力专业能力的法官队伍;科学构建民事案件终审制度,完善强制执行立法,防止诉权滥用,培育有利于维护司法公信力的社会文化共识。The Decision of the Fourth Plenary Session of the Eighteenth Central Committee put forward thetrial-centeredtheory.The trial-centered theory reshapes the new recognitions of civil trial,that is,the civil trial is the center of civil dispute resolution mechanisms,the civil judgment is the center of civil trial,and the civil claim judgment is the center of civil judgment.It is necessary to build a court-centered comprehensive civil dispute resolution mechanism with the trial-centered theory,including promoting and improving the construction of parallel dispute resolution mechanisms to defend civil trial as the center of civil dispute resolution mechanisms,and pushing forward and perfecting the construction of parallel courts to facilitate the parties to accept and access the civil trial as the center of civil disputeresolution.In the meantime,it is also important to build up the trial-centeredcivil justice with the credibility of civil judgments,including forging the credibility of civil judgments with the claim judgments,training the judges with the professional capability to establish judicial credibility,scientifically constructing the system of final adjudication of civil cases,perfecting the legislation of compulsory enforcement,preventing the abuse of litigation rights,and fostering social and cultural consensus beneficial to maintaining judicial credibility.
