史学与法学视域下:宋代慈幼救济现象的法律干预

摘　　要：关于宋代慈幼救济现象的法律干预问题,是宋史社会救济研究中的一个重要分支。文章在史学与法学视域下,结合具体的史实,通过法律干预的方式,对宋代慈幼救济现象进行分析。其内容包括宋代之前的历代社会对慈幼救济的重视和立法记录,以及宋代慈幼救济中的法律干预措施。从中分析出宋代弃婴现象严重的原因与"土地和贫穷"的联系,统治阶级重视慈幼救济与"社会矛盾和社会稳定"的联系以及法律干预与"政权制度与统治手段"的联系。The legal intervention of salesian relief in Song Dynasty is an important branch of social relief research in Song history. From the perspective of historiography and jurisprudence, this paper analyzes the salesian relief phenomenon in Song Dynasty in detail by means of legal intervention and combining with specific historical facts. Its contents include the attention and legislative records of the previous dynasties to salesian relief, as well as the legal intervention measures in the salesian relief in Song Dynasty. From this point, it is recognized that the reason for the serious phenomenon of abandoned infants in Song Dynasty is related to "land and poverty". The ruling class attaches importance to the relationship between salesian relief and "social contradictions and social stability". The relationship between legal intervention and "regime system and ruling means".
