摘 要:监察委员会调查权具有集合行政、纪委、检察等多重职务犯罪侦查权的特点,但与上述权力存在诸多区别。尽管调查权的适用对象限于职务违法行为和职务犯罪行为,与刑事诉讼侦查权极为相似,但监察委员会调查权的行使并不适用《刑事诉讼法》,相反,其法律依据是《国家监察法》。在司法适用层面上,关于监察委员会调查权的制度设计,难以有效置于刑事诉讼侦查权运行框架之中,尚存在必要的完善。有鉴于此,为消除调查权运行中可能面临的法治风险,当务之急是要检视《国家监察法》中调查权与《刑事诉讼法》中侦查权的关系,构建从法律文本转化为司法实践之路径,以期与司法程序无缝衔接,进而在法治中国的轨道上实现调查权的有序运转。The investigative power of supervisory commission has the characteristics of collecting administrative,disciplinary and procuratorial powers. Although its investigation object is limited to duty violations and duty crimes,which is similar to the power of criminal investigation. The exercise of the power of investigation by the supervisory commission does not apply to the criminal procedure law. On the contrary,its legal basis is the law of state supervision. On the application of judicial practice,the system design of the investigation power of the supervisory commission is difficult to be placed in the framework of the criminal investigation power effectively. Besides,there is still a long way to go. For this reason,to eliminate the rule of law in the operation of such possible investigations risk,it is necessary to examine the national inspection act enforcement power in the relationship with the indictment in the criminal procedure law and build from the legal text into the effective path of judicial practice. Furthermore,seamlessly connect with the judicial process and realize the orderly operation of the investigation right on the track of the rule of law in China.
