摘 要:针对互联网经济中"去劳动(雇佣)关系化"的主张,需要对互联网经济中的用工关系性质进行辨析。雇佣关系仍然是互联网经济中用工关系的基本形态,其性质仍然是一种从属性的雇佣劳动。互联网经济中雇佣关系的特点为:表面的松散管理与内在的严格控制、形式上的独立自主与实质的劳动从属、名义上的平等权利与真实的失衡关系。雇佣关系的确认对调整互联网经济中的用工关系具有重要的政策价值和现实意义,只有确认雇佣关系基本框架,并加强和改善劳动法律规制,方能实现劳动者基本权益保障和互联网经济有序持续发展的内在统一。This article analyzes the nature of the employment relationship in the Internet economy against the tendencies of “avoiding the employment relationship”.The author believes that the employment relationship is still the basic form of employment in the Internet economy along with the very existence of subordination in this relationship.The article argues that the employment relationship in the Internet economy includes three characteristics: appearing loose management with inherent strict control, seemingly autonomous work with disguised labor subordination, and superficially equal positions with imbalanced power relationship.Recognizing the existence of employment relationship has important policy and practical impact for adjusting labor relations in the Internet economy.Only based on the employment relationship while strengthening and improving labor laws and regulations, can we effectively protect the basic rights and interests of workers, and promote an orderly and sustained development of the Internet economy.
