摘  要:尽管"三步法"是专利创造性评判通常采用的审查基准,但其针对化合物发明的具体适用仍然存在一些难题。替格瑞洛案二审判决虽提出了"骨架"结构这一概念,并将其应用于"三步法"中,但未能在"骨架"结构与化合物的功能和活性之间建立有效的关系。笔者拟从此案出发,就如何在化合物领域准确诠释"三步法"的应有之义做一探讨。Although the three-step approach is generally used for assessing inventive step of inventions, it is difficult to apply the approach to chemical compound inventions sometimes. Final judgment in the Ticagrelor case proposed to apply the concept of “skeleton” structure to the three-step approach in chemical compound inventions. However, the relationship between the “skeleton” structure and the function or activity of a compound is failed to be established. From this case, the authors try to discuss how to apply the three-step approach rightly and exactly in chemical compound inventions.
