新监察体制下人民监督员制度的转向

摘　　要：人民监督员制度本是监督检察机关办理职务犯罪案件,防止其发生执法不公、侵犯人权的一项行之有效的制度。但随着检察机关该项职能转隶于监察机关后,人民监督员制度就处在存与废的十字路口。在新的监察体制下,使人民监督员制度转向成为监督监察机关调查职务犯罪行为的一种外部监督制度,不仅符合人民监督员制度的本质属性,也弥补了对监察机关监督和制约的不足。作为监督监察机关的一项制度安排,一方面需要促进与人大监督制度、检察机关监督制度以及监察机关自身监督制度的相互衔接与配合,另一方面也应从立法、选任、管理、监督范围等方面予以重构。The system of people's supervisor is an effective system for supervising procuratorial organs to handle cases of duty crimes and prevent them from unfair law enforcement and human rights violations.However,with the transfer of the procuratorial organs to the supervisory organs,the people's supervisor system has been faced with the intersection of preservation and abolition.Under the new supervision system,the system of people's supervisors has been turned into an external supervision system for the supervision and supervision organs to investigate acts of duty crimes.As a system arrangement of supervisory and supervisory organs,the people's supervisor system needs to promote the mutual connection and cooperation with the supervision system of people's congress,the supervision system of procuratorial organs and the supervision system of supervisory organs themselves.
