摘 要:为强化法学实践教学,美国的法律诊所式教学法被我国法学院移植过来。然而,在中国的法学教育实践的土壤中,法律诊所式教学法却产生了"本土化困境":经验主义与理性主义的法学教育思维模式难以对接、法律诊所式教学法存在的功能性缺陷以及师资、经费及案源等方面的匮乏,这些都制约着法律诊所式教学法在中国大范围地适用。湖南师范大学法学院与长沙市中级人民法院共同合作,发起的"三段六步全程参与式庭审实战教学法",不仅吸收了法律诊所式教学法的优势,更超越了它在中国实践的本土化困境,不啻为法学实践教学本土化的一次全新探索。In order to strengthen the practical teaching of law,the American law clinic teaching method has been transplanted by Chinese law schools.However,in the soil of China's legal education practice,the legal clinic teaching method has produced “localization dilemma”: The incompatibility of the thinking mode of legal education between empiricism and rationalism,the functional defects of legal clinic teaching method and the shortage of teachers,funds and sources of cases restrict the wide application of legal clinic teaching method in China.The law school of Hunan normal university and the intermediate people's court of Changsha jointly launched the “three-stage,six-step,whole-process participatory trial practice teaching method”,which not only absorbed the advantages of the legal clinic teaching method,but also went beyond the localization dilemma of its practice in China.It was not only a new exploration of the localization of law practice teaching.
