摘 要:举报人在行政法上规定的权利状态是判断举报人是否享有行政诉讼原告资格的基础。举报人的权利与行政诉讼原告资格的关键因素"权利"、"利益"以及"关系"相结合可以判定举报人的行政诉讼原告资格。当前只有在法律规范中明确规定举报人可以获得奖励及答复的权利的时候,举报人享有提起行政诉讼的原告资格。举报人其它的举报权利被侵害的时候需要综合权利、利益及关系因素才能判断举报人是否具有行政诉讼原告资格。为了公共利益,可以将举报人的原告资格由"有限"拓展至"扩大",即可以在与行政公益诉讼相关的方面赋予举报人更广泛的原告资格。The right status of the informer stipulated in administrative law is the foundation for judging whether the informer is qualified for the plaintiff of administrative litigation. The rights of the in former can be combined with key factors of right, interest and relation for the plaintiff qualification in administrative litigation to determine the plaintiff qualification of the informer. At present, only when it' s expressly regulated in legal norms that the informer can gain the right to reward and reply, the in former is entitled to the plaintiff qualification in administrative litigation. When other informing rights of the informer are infringed upon, factors in eluding right, interest and relation must be taken into consideration in order to judge whether the informer has the plaintiff qualification in administrative litigation. For the sake of public interest, the plaintiff qualification of the informer can be expanded from u limitedn to u enlargedv , that is, more extensive plaintiff qualification can be given to the informer in terms of aspects related to administrative public interest litigation.
