摘 要:郑玄在《周礼》《礼记·王制》注中提出的"设法"概念,既是弥合《周礼》《王制》对封建制度受地面积的矛盾记载的注经思路,也发展成为传统中国原则性与灵活性统一的制度思想。这一经注思想与宋儒义理解经结合,"师其意不师其迹"等崇尚"法意"的立制、变法和制度实践思想进一步彰显、定型。还原此一思想理路,对于理解里甲、保甲、团练等累进式制度设计何以为是、如何执行,乃至传统中国的制度设计和治理实践,具有重要的思想意义和方法论启示。In order to bridge the contradictory record of the area of the feudal system in Zhou Li(《周礼》)and Book of Rites(《礼记·王制》), Zheng Xuan put forward the concept of "Shefa"(设法) in the notes.Shefa developed into the system thought of the unification of principle and flexibility in traditional China. In Song Dynasty, it combined with Confucianism in understanding Classics."Division of its meaning without division of its track" was highlighted." Spirit of system" derived from it. The research of Shefa is very important to understand the progressive system design such as Lijia(里甲), Baojia(保甲) and militia. It also has political thought and methodological significance.
