摘 要:生态文明是人类历史经验的结晶,也是对未来的共识。少数民族朴素的生态伦理观与恢复性司法理念具有共同的价值基础。民族习惯法对于恢复性司法的立法、司法、执法等方面具有积极性价值。在西南少数民族山区环境资源犯罪防控中,以新型村规民约为时代背景的民族习惯法的规范载体,通过非正式社会化纠纷解决机制,民族习惯法得以介入环境冲突处理模式,运用补植复绿、恢复原状、增殖放流以及间接修复等非刑罚性处罚措施,践行民族习惯法在恢复性司法中对生态保护、环境修复的价值导向与促进作用。Ecological civilization is the crystallization of human historical experience and the consensus of the future.The simple ecological ethics of ethnic minorities and the philosophy of restorative justice have a common value basis. Ethnic customary law has a positive value of legislation, judicature and law enforcement resources of restorative justice. In the prevention and control of environmental resource crime in southwestern minority mountainous areas, the new-type village rules and regulations are taken as the standard carrier of ethnic customary laws under the background of the time. Through informal socialized dispute resolution mechanism, ethnic customary law intervenes in the settlement mode of environmental conflict dispute. By means of non-penal punishment measures such as replanting, restitution, proliferation and releasing, and indirect restoration, the historical value of ethnic customary law in ecological protection and environmental restoration in restorative justice is practiced.
