我国审查逮捕过程中的讯问制度研究

摘　　要：审查逮捕讯问是侦查监督的核心程序,是犯罪嫌疑人人权保护的关键环节。由于传统诉讼理念的影响,检察引导侦查机制、"捕后不诉率"等考核指标的存在,以及讯问过程缺乏有效监督,我国审查逮捕讯问制度偏离了公正性轨道,出现了讯问主体立场不一、讯问过程流于形式、讯问人权保障薄弱等问题。为完善审查逮捕讯问制度,应改革不合理的权力配置结构和考核、追责机制,使审查逮捕讯问的公正审查功能归位;坚持讯问主体的公正性,构建递进式讯问模式;完善权利义务告知模式,强化律师帮助的实效性,加强人权保障;简化讯问笔录制作,建立有利证据移送制度;实行讯问同步录音、录像制度,加强律师对讯问过程的监督,探索建立逮捕听证制度,完善监督机制。Interrogation of arrest review system is the core of investigation supervision work, and is of great significance for the protection of the personal freedom right of criminal suspects. However, due to the influence of traditional litigation principles, the existence of procuratorial guidance for investigation mechanism and evaluation indicators such as "the rate of non-prosecution after arrest", and the lack of effective supervision of interrogation process,China’s Interrogation of arrest review system deviates from the track of fairness, resulting in different positions of interrogators, formality of interrogation process and weak protection of human rights. Suggestions are: reforming the unreasonable power allocation structure and assessment and accountability mechanism so that the function of fair examination of the system can be put in place;upholding the faire situation of interrogators and constructing progressive interrogation mode;perfecting the right and obligation informing mode and strengthening the effectiveness of lawyer’s assistance to strengthen human rights protection;simplifying the production of interrogation transcripts and establishing the system of transferring favorable evidence;The system of simultaneous recording and video recording of interrogation and lawyers’ supervision over the interrogation process should be enhanced, and arrest hearing system should be explored to strengthen supervision mechanism of the interrogation process.
