摘  要:明确公立高校教师的法律地位,保护教师权益,实现国家利益与个人利益的"双赢",在当前推进"放管服"和科研评价体制改革的背景下,极具重要意义。在公私法益交融的背景下,高校教师的法律地位是特殊劳动者,包含"劳动者"和"特殊性"双重内涵。一方面,教师具备劳动者的特征,可以从教育生发逻辑、人事制度改革发展趋势、教师权益保障、聘用合同性质四个方面加以证明;另一方面,教师又因自身固有的公共性和学术性有别于普通劳动者,体现为职业属性和人事管理机制的特殊性。确立特殊劳动者定位的意义在于提升了劳动法律制度的适用空间,完善了教师法律治理框架,又不会动摇高等教育的公共性基础。With the reform of education system and the improvement of teachers’ awareness of rights, it is urgent to define the status of teachers in public universities. Under the background of blending public interests with private interests, this paper argues that the legal status of teachers is “special laborer”, which includes the dual connotation of “laborer” and “particularity”. On the one hand, teachers have the characteristics of mental laborers, which can be proved from four aspects: the logic of the birth of education, the trend of the reform and development of personnel system, the protection of the rights and interests of teachers and the nature of the contract of employment. On the other hand, teachers show different characteristics from ordinary laborers because of their own inherent public and academic characteristics, which can be proved from two aspects: the particularity of occupation and the particularity of personnel management mechanism. The significance of this standpoint lies in introducing labor laws and regulations, so as to improve the legal governance framework of teachers, which does not affect the publicity of higher education.
