摘 要:国务院提出要加快培育发展住房租赁市场,不少专家学者也提出将房屋租赁甚至不动产租赁列为物权并进行物权登记。文章从民法基本法理及外国立法例出发,认为房屋租赁权属于债权,不具有物权的性质,不能规定为物权,但可以予以不动产登记,并探讨了租赁权不动产登记的方案和利弊。State Council issued speeding up housing tenancy market of cultivation and development, then, many experts and scholars have also proposed that housing tenancy or even real property lease should be listed as real right to register. Based on basic legal principles of the civil law and the legislation examples of foreign countries, this article considers that right to lease houses belongs to credit and hasn’t the nature of real right, so it can’t be defined as real right, but can be registered as real property. Meanwhile, the scheme and advantages and disadvantages of real property registration of the leasehold are also discussed.
