摘 要:随着无人驾驶汽车在世界范围内从实验平台走向城市道路,其高科技属性和人造物特征,难以完全避免交通事故的发生。在无人驾驶模式下交通事故的责任认定及损害赔偿展开都对现有法律关于机动车交通事故责任和产品责任的适用提出挑战,因此亟需厘清法律责任,通过现有《侵权责任法》的调整确定无人驾驶汽车保有人的无过错责任,辅以监管机构、分析中心和强制保险的制度构建,在技术创新和法律衔接的基础上确保受害人的权益得到保障。because of the high safety and convenience, driverless cars are rapidly moving from experimental platform to urban roads around the world. Due to the high-tech attributes and man-made characteristics of driverless cars, it is difficult to completely avoid accidents.driverless cars have a huge challenge on motor vehicle accident liability and product liability. It is necessary to clear the no-fault liability of driverless car owners through the adjustment of the Tort Liability Law,In addition, the system of regulatory agencies, analytical centers and compulsory insurance are constructed to ensure the right of victims on the basis of innovation and legal convergence.
