摘　　要：P2P互联网借贷平台的刑法规制较为特殊。互联网金融的开放性促使了P2P互联网借贷相比于传统金融更容易出现非法集资罪,涉及P2P互联网借贷犯罪的罪行判定还没有体现出理性化的刑事政策。把企业正常生产运营作为网络借贷犯罪不够恰当,资金池定性概念较为模糊,涉案处罚人员范围较宽、传统非法集资罪处罚力度较重。因此,应重新梳理扩大刑法规制作用范围的理念,变革僵化的入罪标准,进一步明确免于刑事处罚和非犯罪行为的事由,制订"金额+情节"的综合性定罪量刑标准,缩小共同犯罪认定范围。The criminal law system of P2P Internet lending platform is rather special. The open nature of Internet finance has made P2P Internet lending more vulnerable to illegal fundraising than traditional finance. This paper analyzes the sample data of China's P2P Internet lending crimes, and finds that the crimes committed by the sample defendants are all illegal fund-raising crimes. The established P2P platform is mainly for the purpose of corporate financing and provision of professional intermediary services. The study found that the determination of crimes involving P2P Internet lending crimes has not reflected rationalized criminal policies. It is not appropriate to regard the normal production and operation of enterprises as a crime of cyber lending. The concept of the qualitative nature of the pool of funds is rather vague, the range of penalties involved is relatively wide, and the penalty for traditional illegal fundraising is severe. Therefore, this article believes that we should re-examine the concept of expanding the scope of criminal law acts, change the incriminating standards of incrimination, further clarify the reasons for exemption from criminal punishment and non-criminal activities, formulate a comprehensive standard of "amount + plot", narrow the common criminal scope.
