边界:辩护律师和被羁押者通信的范围

摘　　要：现行规范确立的被羁押者通信审查制度导致辩护律师和被羁押者之间的通信受到限制,由于该限制的内容抽象,致使他们之间的通信在实然中困难甚至不能。为了激活该通信制度,提出以法律服务或者法律帮助的法律关系为核心确定辩护律师和被羁押者之间的通信范围。他们之间为了对抗指控而就案件的实体内容、程序性内容进行的信息沟通应当属于通信的内容;他们之间不能就被羁押者与案件无涉的家事、民商事,向第三人转达的信息,要求毁损特定对象的内容进行通信沟通。通信审查机关对属于通信沟通的内容应当及时转交对方当事人。The censorship of communication for detainees established by the current norms restricts communication between defense lawyers and detainees,which makes communication between them difficult or even impossible in practice due to the abstract content of the restriction.In order to activate the communication system,it is proposed to define the range of communication between defense lawyer and detainee based on the legal relationship of legal service or legal assistance as the core.The communication between them regarding the substantive and procedural content of the case in order to fight the allegation shall be the content of communication,they cannot communicate with each other on matters unrelated to the case,such as family affairs,civil and commercial matters,information conveyed to a third party,or request to damage or destroy specific objects.The communication review authority shall promptly transfer the content about the communication to the other.
