论我国法官职业伦理之德性建构

摘　　要：“徒法不足以自行”。防治司法腐败,保障司法公正,法官具有关键性作用。法官职业伦理则对塑造法官职业信仰,约束法官职业行为,培养法官职业美德,都是不可或缺的。在当前社会背景下,司法改革正如火如荼进行。在司法技术层面和制度层面,改革取得了很大的进步和发展,改变了原有落后的局面。但在司法改革的软件方面,也即法官的伦理道德方面却捉襟见肘,改革迟缓,效果不佳,以至于影响了法官在人们中的信誉和司法的公信力。法官在道德伦理上的发展水平直接影响着司法改革的水准,甚至是关系到司法改革的成败。所以,在当下,法官职业伦理的发展与完善,法官职业伦理之德性发展与建构,具有重要的理论和现实意义。"Law does not work itself".Judges play a key role in preventing and curbing judicial corruption and guaranteeing judicial justice.Judges'professional ethics is indispensable for standardiz-ing their professional behavior,shaping their professional beliefs and cultivating their professional virtues.Currently,the judicial reform is in full swing.On the technical and institutional level,the reform has made great progress and has changed the original backward situation.In the software aspect,however,that is,the ethics and morality of judges,the reform is so slow and ineffective that it has affected the credibility of judges and judiciary.Judges'moral and ethical development level has a direct impact on the quality and even on the success or failure of the judicial reform.Therefore,at present,the development and perfection of judges'professional ethics,and the virtue development and construction in judges'professional ethics,have important theoretical and practical significance.
