摘 要:未经抵押登记的不动产抵押合同不能依法律行为转换理论转换为连带责任保证合同。虽未办理抵押登记,但抵押合同作为负担行为已经发生效力。该合同具备双重效果。一方面,债权人有权请求抵押人办理抵押登记,借此设立抵押权。另一方面,主债务届期未受清偿时,债权人有权请求抵押人以抵押物变价所得价款清偿主债务。此项请求权并非担保物权,仅为相对性担保权,不得对抗第三人。包含此项请求权的抵押合同可被作成赋予强制执行效力的公证债权文书。The real estate mortgage contract without mortgage registration should not be converted into joint liability guaranty contract according to the theory of legal act conversion. Although the mort gage registration has not been done, mortgage contract has already come into force as an Obligation Act with dual legal effects. Firstly, the creditor is entitled to request the mortgager to establish mortgage right through registration. Secondly when the principal debt is not paid off by the debtor on the appoint ed date, the creditor is entitled to request the mortgager to pay off the principal debt with the money ob tained from the sale of the guarantee. Such right of the creditor is not a real right, but a relative right of security without effect against the third party. A mortgage contract containing such right can be made in to notarial obligatory right document with compulsory execution effect.
