未成年人刑事法律援助有效性实证分析

摘　　要：通过实地调研发现,目前审查起诉和审判阶段未成年人法律援助覆盖面明显扩大,律师权利也得到了较为充分的保障,但侦查阶段法律援助率低、通知与指派信息交流不畅、律师意见的针对性和专业性不足、未成年人法律援助专业化程度低等问题依然突出。应确立强制辩护原则,将未成年被害人纳入应当援助的范围,扩充法律援助律师权利,通过少年司法信息共享平台提升通知、指派和律师介入办案的效率,建立专业化法律援助队伍以提高未成年人法律援助的有效性。According to the local investigation,the coverage of legal aid for juveniles on criminal examination and prosecution as well as trial phases has been significantly expanded.The rights of lawyers are also more guaranteed.However,there still remain prominent problems,including the low rate of legal aid in the investigation stage,the poor communication of notification and assignment information,the lack of pertinence and professionalism of lawyers’opinions,as well as the low degree of specialization of legal aid for juveniles.We should establish the principle of Coercive Defense,include the underage victims into the scope of assistance,and expand the rights of legal aid lawyers.We should also improve the efficiency of notification,assignment and lawyer intervention through the juvenile justice information sharing platform,and establish specialized legal aid teams to improve the effectiveness of legal aid for juveniles.
