案件管理与一体化背景下的欧洲大陆法系民事诉讼发展动向

摘　　要：在欧洲范围内,大陆法系国家民事诉讼制度的发展受到案件管理与一体化双重的影响。案件管理注重于司法效率的提高。一体化则侧重于寻求程序的共识,促进程序的合作与融合。一体化使得大陆法系各国为提高诉讼效率所进行的努力获得正当性;欧盟立法与法律解释的英美法视角对大陆法系国家产生潜移默化的影响;一体化也为大陆法系国家具体制度或法律解释的变革提供了直接的动力。在案件管理与一体化的合力下,欧洲大陆法系各国的民事诉讼制度未来将继续努力在司法效率与质量之间寻求平衡。In the European context, the development of the civil procedure system in civil law countries is under the dual influences of case management and integration. While case management focuses on the improvement of judicial efficiency, integration focuses on seeking the consensus of procedures, as well as promoting the cooperation and fusion of procedures. Integration makes the efforts civil law countries pay to enhance the efficiency of litigation gain legitimacy;EU legislation and legal interpretation in the perspective of Anglo-American law have a subtle influence on civil law countries;integration also provides direct incentives for the revolution of specific system or legal interpretation in civil law countries. Under the resultant force of case management and integration, the civil procedure system of continental European countries will continue its efforts to strike a balance between judicial efficiency and quality in the future.
