民用无人机社会风险防控与法律监管

摘　　要：随着我国民用无人机产业的跨越式发展,民用无人机“黑飞”现象频繁,严重干扰了我国正常的航空秩序,危害国家安全和公共安全,侵犯公民的个人隐私等。当前我国关于民用无人机立法缺失、监管主体责任不明确、现行民航法规体系对无人机规定相对空白。本文在借鉴国外立法的基础上,提出了完善我国民用无人机相关法律体系、规范民用无人机的法律属性、明确无人机法律监管机构和部门职责、打击民用无人机违法犯罪行为、保护国家安全和公民的合法权益等对策和建议,从而推动民用无人机产业的健康发展。With the leapforward development of civil drone industry in China,Thephenomenon of"black flight"of civil UAV is frequent,which seriously interferes with China's normal aviation order,endangers national security and public safety,infringes on citizens'personal privacy and so on.At present,there is a lack of legislation on civil UAV in our country,the responsibility of the subject of supervision is not clear,andthe current civil aviation laws and regulations system are relatively blank on UAV.On the basis of drawing lessons from foreign legislation,thispaper putsforward some countermeasures and suggestions,such as perfecting the relevant legal system of civil UAV,standardizing the legal attribute of civil UAV,defining the responsibilities ofUAV legal supervision agencies and departments,cracking down on the illegal and criminal acts of civil UAV,protecting the national security and the legitimate rights and interests of citizens,so as to promote the healthy development of civil UAV industry.
