民事庭前会议的完善路径——以“庭审中心主义”的实现为目标

摘　　要：作为审前准备程序的核心一环,庭前会议的设置与“庭审中心主义”改革在动因上具有一致性。充分的审前准备是落实庭审中心主义的应然条件。民事庭前会议的设置可以在实体和程序层面有效保障庭审程序的运作,但强职权主义的驱动和适用上的混乱限制了庭前会议功能的发挥。在立法和实践中,庭前会议开展规则的不确定性和内容的模糊性造成了庭前会议的混乱适用。面对庭前会议在司法实践中虚置的局面,庭前会议的完善应从法官与当事人各方的权限配置关系出发,将庭前会议置于民事诉讼的程序性构造框架之下,对庭前会议的启动和适用规则加以阐明,明确其程序定位,重新整合和构建与“庭审中心主义”相适应的庭前会议制度,才能真正促进集中审理和庭审实质化的实现。As a core part of the civil pre-trial procedure,the setting of the pre-trial conference is consistent with the motivation of court centralism reform.Adequate pre-trial preparation is the condition for the implementation of court centralism.The establishment of the civil pre-trial conference can effectively guarantee the operation of the proceedings at both the entity and the procedural level,but the drive of strong authority,and the confusion of initiation and application limit the function of the pre-trial conference.In legislation and practice,the uncertainty and ambiguity of the pre-trial rules have created a situation in which the pre-trial conference is confusing.In the face of the situation in which the pre-trial conference is falsified in judicial practice,the pre-trial conference should be improved from the relationship between the judges and the parties,and should be placed under the civil procedural framework.Therefore,it is necessary to clarify the initiation and application rules of the pre-trial conference,clarify its procedural positioning,and re-integrate and construct a pre-trial conference system that is compatible with the court centralism,in order to promote the realization of centralized trial and substantive trial.
